This Privacy Policy applies to your use of all the sites and services owned or operated by FlexFitnessCenter.com (collectively “we, ” “us, ” or “our”), including Flex Fitness Center’s physical facility, and any other website that we may own or operate currently or in the future (collectively, the “Site” or “Sites”). Unless we say otherwise, all references to the Sites in this policy include all such sites. This policy does not apply to your use of sites to which any of the Sites link. This policy covers only information collected on the Sites and does not cover any information collected offline by us.

 

Personal Identification Information

 

We may request personal identification information from you (such as your name, street address, telephone number, credit card number, email address, and/or any other identifier that permits the physical or online contacting of you) in connection with your use of, or participation in, membership registration for FlexFitnessCenter.com, our contests, sweepstakes, promotions, games, surveys, forums, subscription registrations, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, visitors’ requests for free products or services, or additional information (including via email to us), and in connection with other activities, services, features or resources we make available on any of our Sites. In all of these cases, we will collect personal identification information from you only if you voluntarily submit such information to us. Except as otherwise provided in this policy, we reasonably endeavor to ensure that we never intentionally disclose any personal identification information about you as an individual user to any third party without having received your permission (through opt-in or similar procedures) except as provided for herein or otherwise as permitted or required under law. We will also release specific information in special cases, such as if there is an attempted breach of the security of the site, or a physical or property threat to you or others. We may also transfer user information, including personally identifiable information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division, or other fundamental corporate change. We may provide access to your personally identifiable information to our contractors who are performing services for us in connection with our site or the services that you have requested.

We may share this aggregate statistical information with our partners, suppliers and other third parties, but we will not share any individual names, personal navigational, or other personal information. For example, we may use a third-party advertising company to serve ads when you visit our site. We may share demographic and preference information with this company to allow them to display appropriate advertisements for you.

 

Further, from time-to-time we contract with a third party web analytics provider to help manage and optimize our Sites. We use this service to help us measure the effectiveness of our advertising and how visitors use our Sites. To do this, we use Web beacons and cookie technology on the Sites. The type of information we collect includes such information as the number of hits a webpage receives, type of browser used, and number of times a visitor makes a purchase from a particular promotion. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which products and services most interest our users, and what kinds of offers our users like to see. Although this third-party provider logs the information coming from our site on our behalf, we control how that data may and may not be used.

 

Special rules relating to children

 

The Children’s Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age. Our Sites are not directed at children under 13 years of age but, we recognize that with proper adult supervision some parents might permit their children to visit our Sites and use our online services. COPPA requires that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of our Sites.

 

When your child attempts to register and/or provide personal information to FlexFitnessCenter.com, we require a parent or legal guardian to:

 

  1. Register their child by completing the Permission to Participate Form and returning it, by facsimile or postal mail, to us as set forth on the form;
  2. Review our Privacy Policy and verify that the child’s parent or guardian knows about and authorizes our information practices related to children protected by COPPA; and
  3. Verify via email confirmation a second authorization that the parent or guardian consents to these Term of Use and Privacy Policy. Send such email authorizations to info@FlexFitnessCenter.com.

 

Once parental notice and consent has been verified, the information we collect will be treated the same as information collected from any other user. Without verified parental notice and consent, we will not knowingly collect personal information relating to children under 13 years of age, and if we learn that we have inadvertently collected such information, we will promptly delete it.

 

How parents can access their children’s information

 

In compliance with COPPA, a parent or legal guardian may request from us to review, delete or stop the collection of personally identifiable information relating to their child or any child in their legal custody who is under 13 years of age. You may do so by following the instructions below regarding Access to/Correction of Information. If you request that no further information about your child be collected or used, we will be required to terminate your child’s ability to use any part of the service or feature that requires a user to “sign in.”

Access to/correction of information

 

If you would like to review any personal information we have retained about you in our database, please send us an email request for this information at info@FlexFitnessCenter.com. To help us address your request, please specify which information you wish to review. Once you have reviewed this information, at your request we will correct personal information about you that you state is erroneous. To request such a correction, please send an email to info@FlexFitnessCenter.com. You should be aware, however, that it is not always possible to completely remove or modify information in our databases and servers although we will always make reasonable efforts to do so upon your request. Please also understand that due to the volume of traffic on the site and correspondence received, we cannot make any representations about the timeliness of the making of such modifications. In addition, we are unable to modify your information in the records of any third party who has been provided with your information in accordance with this policy.

 

Choice opt-in/opt-out

 

If you “opt-in” to receive information from us, you can change your mind later. If at any time you would like to stop receiving such information or opt-out of a feature, you may go back to FlexFitnessCenter.com and unsubscribe. You should be aware, however, that it is not always possible to completely remove or modify information in our databases and servers, although we will always make reasonable efforts to do so upon your request, and we are unable to have your information removed from the records of any third party who has been provided with your information in accordance with this policy. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. My using the site, you signify your acceptance of our Privacy Policy, your promise to comply with the representations you make and contained in the Privacy Policy and Terms of Use, and your understanding of the scope and limitations of the protections provided under the Privacy Policy and Terms of Use. REFUND POLICY

Our goal is to make sure you are completely satisfied with the items you order and your experience with FlexFitnessCenter.com. Depending on the reason for the return and the condition of the product, there may be several options available to you.

 

  • If you would like to return an unopened product for any reason, we can either issue a refund to your method of payment, or we can apply an in-store credit to your account that you can use towards a future purchase. The refund issued or in-store credit applied is for the price of the product only and does not include any shipping fees charged for delivery.

 

  • If you would like to return a product that you’ve opened, we will provide an in-store credit for the percentage of product remaining. Any consumption greater than 20% of the original product is not available to be returned. The in-store credit applied is for the price of the product only and does not include any shipping fees charged for delivery.

 

  • If a product you receive is damaged during shipment, arrives after its expiration date, or is not what you ordered, we can send a replacement right away and provide a prepaid return label for our U.S. and E.U. customers to retrieve the item.

 

  • If a clothing item doesn’t fit properly, we’ll gladly issue an in-store credit to your account for a different size, but must charge for the new shipping fee and the return shipping cost.

 

  • If the item you’d like to return was ordered more than three months ago, or if the item was purchased using in-store credit as part of a previous exchange, we cannot accept the return or issue a refund for any reason.

 

To begin processing any type of return, please contact our Customer Service team and provide your name, the order number, and the reason for returning the product.

 

To speed up the returns process, please return the product along with a copy of your invoice with “Attention: Returns” on the address label.

When returning an item, we highly recommend using a shipping method that provides step-by-step tracking information to help ensure its safe arrival. We are not responsible for the amount of time it takes for an item to be returned to our facility, or if the item is lost or damaged during the return process.

 

Once we have received the product and the return has been processed by our warehouse, we can issue the refund or award the in-store credit to your account.

 

Domestic & European Union Customers

 

We provide return shipping labels for products that were shipped incorrectly (i.e., wrong item delivered), defective or damaged items, products that arrive after the expiration date, or any item that caused an adverse reaction (e.g., vomiting or severe headaches). Sorry, but we cannot issue return labels for issues with taste or lack of results from a product, and the customer is responsible for the cost of shipping when returning these items.
